Website Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the SowYummy Systems Inc. (“SowYummy”) website (“Site”) and its related services. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Acceptance of Terms

By accessing or using the Site, you confirm that you are of the age of majority in your jurisdiction and capable of entering into legally binding agreements. If you do not meet these requirements, you must not use the Site.

Use of the Site

You agree to use the Site for lawful purposes only. You must not engage in fraudulent activities, disrupt the Site, or violate applicable laws and regulations. If you create an account, you certify that all information provided is accurate, current, and belongs to you. You are responsible for maintaining the confidentiality of your account credentials.

Transactions and Payments

Payments are processed via WooPayments, which is fulfilled by Stripe. Accepted payment methods include major credit and debit cards, Apple Pay, and Google Pay. All transactions are processed in Canadian Dollars (CAD). Prices listed on the Site exclude taxes, shipping fees, and any applicable customs duties. Orders are confirmed upon successful payment and are typically fulfilled within three (3) business days.

Shipping and Delivery

Detailed information on shipping and delivery is available in our Shipping and Returns Policy. SowYummy ships to locations within Canada and the USA. If you are located outside of these countries, contact us at connect@sowyummy.com for a custom shipping quote. Customers are responsible for any customs duties or import taxes incurred.

Subscriptions

Subscriptions are billed automatically at the frequency selected during purchase. Customers may cancel or pause (“suspend”) subscriptions at any time, with a maximum of three (3) suspensions allowed per 12-month period.

Promotions and Discounts

Unless explicitly stated otherwise, multiple promotions or discount codes cannot be combined. Gift cards issued by SowYummy do not expire, in compliance with the Consumer Protection Act.

Privacy and Data Use

The use of the Site is subject to our Privacy Policy. SowYummy collects personal information, such as your name, email address, shipping address, phone number, and payment details, to process and fulfill orders. This information is shared only as necessary with Stripe for payment processing and with ClickShip, courier companies, and Canada Post for shipping.

Product Availability

If a product becomes unavailable after an order is placed, SowYummy will contact you to offer a substitution or a refund.

Third-Party Services

The Site integrates with third-party providers, including Stripe for payments and ClickShip/Canada Post for shipping. SowYummy is not responsible for the practices or performance of these providers. Refer to their respective terms and policies for additional information.

Disclaimers and Limitation of Liability

The Site and its content are provided “as is.” SowYummy does not guarantee error-free or uninterrupted access. To the fullest extent permitted by law, SowYummy disclaims liability for indirect, incidental, or consequential damages, including delays or issues beyond its control.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and the province of British Columbia. Any disputes will be resolved in accordance with Canadian law.
